City Clerk Statement on Special Election Compliance

Statement from City Clerk Hosam Haggag: I would like to make a couple corrections to statements I made at the Feb. 25 Council Meeting regarding the status of the March 3, 2020 special election compliance.

After conferring with the California Fair Political Practices Commission (FPPC), both Santa Clara's last date to accept contributions deadline of Feb. 21 and Santa Clara's 3rd pre-election deadline of Feb. 25 are specific to Santa Clara, based on local ordinance and only apply to candidates for office in Santa Clara. It does not apply to other campaign committees. We have not filed any violation with the FPPC against the No on C campaign regarding these issues as it does not apply to them. We have informed the campaign committee of the same.

However, in discussing these requirements with the FPPC, we were informed that all campaign committees must file an FPPC Form 497 Contribution Report within 24 hours of receipt of $1,000 or more within 90 days of the election. The amendment to the Feb. 21 contribution report was filed on Feb. 25, more than 24 hours after the contribution.

Furthermore, all campaign committees must file an FPPC Form 496 Expenditure Report within 24 hours of spending $1,000 or more within 90 days of the election. The No on C campaign committee has not filed a single 496 form to-date. Ninety days prior to the election would also include the Dark Money campaign activity that was conducted in December of 2019, but also applies to all expenditures the committee has engaged in up through the March 3 special election. As your elections official, I am amending my formal complaint to the FPPC to reflect these additional violations.
