Minimum Wage for City of Santa Clara

Employers and employees doing business in the City of Santa Clara are subject to the Minimum Wage Ordinance.

On August 22, 2017, the Santa Clara City Council approved a plan establishing the City's local minimum wage. As of January 1, 2020, the City of Santa Clara minimum wage is adjusted annually based on the regional Consumer Price Index (CPI).

New Minimum Wage Effective January 1, 2026

Starting January 1, 2026, the City of Santa Clara’s minimum wage will increase from $18.20 (2025 minimum wage rate) to $18.70 per hour. The 2026 Minimum Wage Posters for the workplace will be available on this webpage by November 1, 2025.

What Does This Mean for Employers?

  • Employers must document all hours worked by employees and keep records for four years.
  • It is unlawful to discriminate or take adverse action against any person in retaliation for exercising their rights protected under the ordinance.
  • Employers must provide their name, business address and phone number in writing to employees at time of hire.
  • Employers must post the Minimum Wage Official Notice at the workplace or job site, informing employees of the rate and their rights, in the top three languages spoken in the City of Santa Clara: English, Spanish, and Chinese.

What Does This Mean for Employees?

  • Covered employees include anyone who performs two hours or more of work per week in Santa Clara.
  • Covered employees are entitled to these rights regardless of immigration status.
