Pavement Preservation Ordinance

The Department of Public Works is responsible for maintaining the City’s street pavement infrastructure and ensuring compliance with the Ordinance.

Persons seeking to make excavations in public rights-of-way are required to obtain an Encroachment Permit. Enforcement of restrictions based on the Pavement Preservation Ordinance is administered through the Encroachment Permit Program.

In an effort to ensure street pavements are preserved, the Department of Public Works seeks to coordinate pavement maintenance work planned by the City with work planned by permittees. 

Background

In February 2019, the Santa Clara City Council adopted a Pavement Preservation Ordinance, Ordinance No. 1998 (PDF), that governs openings in and use of streets and public rights-of-way in order to preserve street pavements. The Ordinance seeks to preserve pavements by restricting cuts and excavations in pavements that have been recently resealed, constructed, reconstructed, or resurfaced. This restriction is 3 years for streets that have been resealed, and 5 years for streets that have been constructed, reconstructed, or resurfaced.
